Mooradian advised the client to present the information honestly to the interviewing officer, including indicating a violation of her nonimmigrant status on the adjustment application itself. Because of the particular circumstances of this case, Mooradian explained, the client was exempt from the ground of inadmissibility relating to both visa overstays and unauthorized employment.
Following a brief interview at the USCIS office in Lawrence, MA, the client was approved for lawful permanent residence. She will now be able to remain in the United States with her U.S. Citizen spouse.
